The following outlines our terms and conditions for products, ordering policies and polices that pertain to the use of this website.
Please read carefully to avoid any issues with your order
All Products made by Sweets By 'Tonia are subject to
the following Terms and Conditions herein.
Our Guarantee
- We promise to do everything in our power to deliver you a cake, donut or confections meet and exceed your expectations.
- We will work with you on every level to make sure you are completely satisfied and happy with your cake. We greatly appreciate the opportunity to provide sweet delicious treats for your occasion and will work to make it an exceptional one!
Ingredients & Allergies
- Sweets By 'Tonia is a home bakery, registered and approved by the Vancivouer Island Health Authority (VIHA) in the city of Nanaimo.
- All products are produced in a home kitchen not subject to public health inspection that may also process common food allergens.
- While our baked goods do not contain peanuts or tree nuts, please note that, upon request, we may use colored candy melts or ingredients for decorating purposes only. These ingredients may be processed on a line with peanuts.
- Should you have an allergy concern, please contact me at info@sweetsbytonia.ca to check on any ingredient that may be used in your baked goods and we will do our best to accomodate any special needs.
- Common food allergens that may be found in the kitchen include: eggs, dairy and wheat. Soy may be present, as it may be found within an ingredient used, such as sprinkles, for example. Our process is to avoid allergy concerns where posisble however cross contamination of these ingredients is possible and can occur.
Placing Your Order
Order Selection
- All photos presented on the site, social media or sent directly to the client are for inspiration, feedback and are representative of the creative intent.
- We strive to maintain a high-level of conistency, however as every cake is a custom creation, final product is not guaranteed to be identical to any photos.
Custom Cakes
- Cake design is a creative and organic process. Cake orders must be placed a minimum of 1 week prior to delivery. We recommend 2 weeks where possible.
- As there are lead-times required in baking and prep we try to make sure there is enough time to make changes if needed.
- Any changes of size, style or flavours of the cake, must be notified at no later than one week prior to final payment and may incur additional charges.
- Changes requested after this date are not guaranteed and are subject to additional charges.
Donuts
- We do not sell singles of donuts at this time. Donuts must be ordered in multiples of 6 (6, 12, 18, 24, etc.).
- Donuts orders must be placed no later than 7PM PST the day before pickup. Orders placed after that will be prepared for the following day.
- Donuts are not guaranteed to be nut-free, we can not orders must be placed no later than 7PM PST the day before pickup. Orders placed after that will be prepared for the following day.
Payment
- 50% deposit must be recieved to confirm order.
- All deposits are non-refundable (once your order is confirmed)
- Final payment is due on day of pick up via e-transfer, credit-card or cash.
- Where availability permits, we may occasionally accept short notice orders. Short notice orders are subject to a rush charge of up to $100.
- All Quotes are valid for 10 days from the date of issue. In the event that the desired date has been filled by another order / customer, prior to the Customer confirming the booking by paying the deposit, Sweets By 'Tonia is not obliged to honor the quote.
- All Quotes are NOT bookings and are subject to availability.
Delivery & Pickups
- Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the Customer to store and care for the cake as per Sweets By 'Tonia instructions.
- If anything is to happen to the cake after this exchange, and deemed to be fault of the Customer through not following the instructions provided or transportation mishaps, Sweets By 'Tonia is not liable for any damages.
- Sweets By 'Tonia is not liable for damage due to client negligence or improper handling once the product has been picked up or delivered.
- The Customer is responsible for checking the state of the product before making final payment upon delivery/pickup. Once the item has been delivered/picked up, the Customer has accepted the item as is, and is responsible to ensure that the products gets to its destination safely and/or is stored as per instructions from Sweets By 'Tonia to achieve best results for taste and quality and to avoid any damage.
- Delivery times are not guaranteed and arrangements will be made with the client for a pre-arranged 2-hour window.
- On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without permission or compensation to you.

USE OF OUR WEBSITE
- You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract.
- You agree to not use our website to conduct any activity that would constitute a civil or criminal offense or violate any law. You agree not to attempt to interfere with our website’s network or security features or to gain unauthorized access to our systems.
- You agree to provide us with accurate personal information, such as your email address, mailing address and other contact details in order to complete your order or contact you as needed. You agree to promptly update your account and information.
- You authorize us to collect and use this information to contact you in accordance with our Privacy Policy.
GENERAL CONDITIONS
- We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending or discontinuing any aspect of the website at any time, without notice. We may impose additional rules or limits on the use of our website.
- You agree to review the Terms regularly and your continued access or use of our website will mean that you agree to any changes.
- You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of our website or for any service, content, feature or product offered through our website.
PRODUCTS AND SERVICES
- All purchases through our website are subject to product availability. We may, in our sole discretion, limit or cancel the quantities offered on our website or limit the sales of our products or services to any person, household, geographic region or jurisdiction.
- Prices for our products are subject to change, without notice. Unless otherwise indicated, prices displayed on our website are quoted in Canadian dollars.
- We reserve the right, in our sole discretion, to refuse orders, including without limitation, orders that appear to be placed by distributors or resellers. If we believe that you have made a false or fraudulent order, we will be entitled to cancel the order and inform the relevant authorities.
- We do not guarantee the accuracy of the colour or design of the products on our website. We have made efforts to ensure the colour and design of our products are displayed as accurately as possible on our website.
THIRD PARTY WEBSITES
- Links from or to websites outside our website are meant for convenience only.We do not review, endorse, approve or control, and are not responsible for any sites linked from or to our website, the content of those sites, the third parties named therein, or their products and services.
- Linking to any other site is at your sole risk and we will not be responsible or liable for any damages in connection with linking.
- Links to downloadable software sites are for convenience only and we are not responsible or liable for any difficulties or consequences associated with downloading the software.
- Use of any downloaded software is governed by the terms of the license agreement, if any, which accompanies or is provided with the software.

You further agree that your Content will not be unlawful, abusive or obscene nor will it contain any malware or computer virus that could affect our website’s operations. - Please note that our website may contain typographical errors or inaccuracies and may not be complete or current. Such errors, inaccuracies or omissions may relate to product description, pricing, promotion, and availability and we reserve the right to cancel or refuse any order placed based on incorrect pricing or availability information, to the extent permitted by applicable law.
- We do not undertake to update, modify or clarify information on our website, except as required by law.

- If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.
GOVERNING LAW
- Any disputes arising out of or relating to the Terms, the Privacy Policy, use of our website, or our products or services offered on our website will be resolved in accordance with the laws of the Province of British Columbia without regard to its conflict of law rules.
- Any disputes, actions or proceedings relating to the Terms or your access to or use of our website must be brought before the courts of the Province of British Columbia in the City of Nanaimo, British Columbia and you irrevocably consent to the exclusive jurisdiction and venue of such courts.
